General rental terms

Working draft. These terms are a template and must be reviewed and approved by a legal professional before being relied upon with customers.

Purpose and scope

These terms govern the rental of event equipment between @@PLACEHOLDER@@ (the lessor) and the customer. They are provided to the customer before the contract is concluded and take precedence over any other terms.

Quote and order

Every rental is covered by a written quote specifying the equipment, the duration, the price and the delivery arrangements. The rental becomes firm upon receipt of the signed quote and any deposit.

Rental period

The period runs from the actual handover of the equipment to its return. Any unagreed late return may be invoiced as an additional day.

Security deposit

A security deposit is required when the equipment is handed over. It is returned after the returned equipment has been checked, less any refurbishment costs.

Condition of the equipment

The equipment is handed over in good working order. A joint condition report is drawn up on departure and on return. The customer has a reasonable period in which to report any fault noticed on receipt.

Customer obligations

The customer uses the equipment for its intended purpose and in accordance with the instructions provided. The customer is responsible for its safekeeping throughout the rental, may not sub-let or modify it, and must comply with the regulations applying to the event, in particular regarding sound levels and copyright.

Liability and insurance

The customer is liable for loss, theft and damage to the equipment during the rental. It is the customer's responsibility to check that their insurance covers these risks. The lessor holds professional liability insurance.

Cancellation

Cancellation terms and any fees are set out in the quote, according to the notice given and the costs already incurred.

Right of withdrawal

For contracts concluded at a distance or off-premises with a consumer, the fourteen-day right of withdrawal provided for in article L221-18 of the French consumer code applies, subject to the exceptions in article L221-28. The exact terms applying to each rental are set out in the quote.

Complaints and mediation

Any complaint must be sent to the lessor in writing. Failing an amicable solution, a consumer may refer the matter free of charge to the consumer mediator whose details appear in the legal notice.

Governing law

These terms are governed by French law.
